=S=> BGB 1177. 1 If the mortgage and the ownership are merged in one person , and the owner is not also entitled to the claim , the mortgage is converted into a land charge . With regard to whether the loan bears interest , the rate of interest , period for payment , notice of termination and place of payment , the provisions laid down for the claim remain decisive .
=S=> BGB 1177. 2 If the claim is also owed to the owner , the rights of the owner under the mortgage are governed , as long as the merger exists , by the provisions applicable for a land charge of the owner .
