=S=> BGB 1176 If the requirements set out in sections 1163 , 1164 , 1168 and 1172 to 1175 are fulfilled only in respect of a partial amount of the mortgage , the mortgage , which on the basis of these provisions passes to the owner or to one of the owners or to the personal debtor , may not be enforced to the disadvantage of the mortgage that remains to the creditor .
