=S=> BGB 1157 A defence which the owner is entitled to assert against the mortgage on the basis of the legal relationship existing between him and the previous creditor may also be relied on in relation to the new creditor . The provisions of sections 892 , 894 to 899 and 1140 also apply to this defence .
