=S=> BGB 1148 In the pursuit of the right arising from the mortgage , the person who is registered as owner in the Land Register is , for the benefit of the creditor , deemed to be the owner . The right of the unregistered owner to assert the objections to the mortgage to which he is entitled remains unaffected .
