=S=> BGB 1141. 1 Where the due date of the claim is dependent on the giving of notice of termination , the notice is effective in respect of the mortgage only if it is given by the creditor to the owner or by the owner to the creditor . For the benefit of the creditor , the person registered as owner in the Land Register is deemed to be the owner .
=S=> BGB 1141. 2 If the owner has no residence within the country , or if the requirements of section 132 ( 2 ) have been fulfilled , the local court [ Amtsgericht ] within whose district the plot of land is situated shall appoint for the owner , upon application by the creditor , a representative on whom the notice of the creditor can be served .
