=S=> BGB 1117. 1 If the issue of a mortgage certificate is not excluded , the creditor acquires the mortgage only when he is provided with the certificate by the owner of the plot of land . The provisions of section 929 sentence 2 and sections 930 and 931 apply to the delivery .
=S=> BGB 1117. 2 The delivery of the certificate may be replaced by the agreement that the creditor is to be entitled to have the Land Registry deliver the certificate to him .
=S=> BGB 1117. 3 If the creditor is in possession of the certificate , it is presumed that delivery has taken place .
