=S=> BGB 883. 1 To secure a claim to the grant or cancellation of a right in a plot of land or in a right encumbering the plot of land or to the alteration of the contents or the priority of such a right , a priority notice may be entered in the Land Register . The registration of a priority notice is also admissible to secure a future or a conditional claim .
=S=> BGB 883. 2 A disposition that is made , after the registration of the priority notice , of the plot of land or of the right , is ineffective to the extent that it would defeat or adversely affect the claim . This also applies if the disposition is made by way of compulsory execution or enforcement of an attachment order or by the administrator in insolvency proceedings .
=S=> BGB 883. 3 The priority of the right to the grant of which the claim relates is determined according to the registration of the priority notice .
