BGB 346. 1 If one party to a contract has contractually reserved the right to withdraw or if he has a statutory right of withdrawal , then , in the case of withdrawal , performance received and emoluments taken are to be returned .
BGB 536. 1 If the leased property at the time of surrender to the lessee has a defect which removes its suitability for the contractually agreed use , or if such a defect arises during the lease period , then the lessee is exempted for the period when suitability is removed from paying the rent .
