BGB 1244 Where a thing is sold as a pledged item , and the seller is not entitled to a pledge or the requirements upon which the lawfulness of the sale depends are not satisfied , the provisions of sections 932 to 934 and 936 apply with the necessary modifications , if the sale was effected in accordance with section 1233 ( 2 ) , or if the provisions of section 1235 or section 1240 ( 2 ) have been observed .
