BGB 307. 2 An unreasonable disadvantage is , in case of doubt , to be assumed to exist if a provision is not compatible with essential principles of the statutory provision from which it deviates , or limits essential rights or duties inherent in the nature of the contract to such an extent that attainment of the purpose of the contract is jeopardised .
BGB 2313. 2 For uncertain or unsecured rights and for doubtful obligations , the same applies as for rights and obligations that are subject to a condition precedent . The heir is obliged in relation to the person entitled to a compulsory share to ascertain an uncertain right and to pursue an unsecured right to the extent that this is compatible with orderly administration .
