| BGB 290 If the obligor is obliged to compensate for the value of an object that has been destroyed during a period of default or cannot be returned for a reason occurring during a period of default , the obligee may demand interest on the amount to be paid as compensation from the point of time onwards on which the determination of the value is based . The same applies if the obligor is obliged to compensate for the reduction in value of an object that deteriorates during the period of default . |
| BGB 366. 2 If the obligor does not make a determination , then the first debt redeemed is the debt due for redemption ; among more than one due debt , the one offering the obligee the least security ; among more than one equally secure debts , the more onerous one ; among more than one equally onerous debts , the oldest debt ; and where all are equally old , each debt proportionally . |
