BGB 136 A prohibition of disposal which is issued by a court or by any other public authority within the limits of its competence is equivalent to a statutory prohibition of disposal of the kind described in section 135.
BGB 925. 1 The agreement between the alienor and the acquirer ( declaration of conveyance ) necessary for the transfer of ownership of a plot of land under section 873 must be declared in the presence of both parties before a competent agency . Any notary is competent to receive the declaration of conveyance , notwithstanding the competence of other agencies . A declaration of conveyance may also be made in an in-court settlement or in an insolvency plan that has been finally and non-appealably confirmed .
BGB 1558. 2 The Land governments are authorised to transfer the competence to keep the register , by statutory order , to one local court [ Amtsgericht ] for the districts of more than one local court [ Amtsgericht ] . The Land governments may , by statutory order , transfer the authorisation to the Land justice administration authorities .
GG 23. 4 The Bundesrat shall participate in the decision-making process of the Federation insofar as it would have been competent to do so in a comparable domestic matter , or insofar as the subject falls within the domestic competence of the Länder .
