BGB 87. 2 When the objects are altered , the intention of the founder should be taken into account , and in particular , it should be ensured that the income of the foundation assets is maintained for the group of persons that it was meant to benefit , as intended by the founder . The public authority may amend the constitution of the foundation to the extent that the alteration of the objects requires this .
BGB 306. 3 The contract is ineffective if upholding it , even taking into account the alteration provided in subsection ( 2 ) above , would be an unreasonable hardship for one party .
BGB 313. 1 If circumstances which became the basis of a contract have significantly changed since the contract was entered into and if the parties would not have entered into the contract or would have entered into it with different contents if they had foreseen this change , adaptation of the contract may be demanded to the extent that , taking account of all the circumstances of the specific case , in particular the contractual or statutory distribution of risk , one of the parties cannot reasonably be expected to uphold the contract without alteration .
BGB 482. 3 The entrepreneur may , before entering into the agreement , make an alteration to the information contained in the prospectus to the extent that this becomes necessary due to circumstances which he was unable to influence .
