| BGB 138. 2 In particular , a legal transaction is void by which a person , by exploiting the predicament , inexperience , lack of sound judgement or considerable weakness of will of another , causes himself or a third party , in exchange for an act of performance , to be promised or granted pecuniary advantages which are clearly disproportionate to the performance . |
| BGB 537. 1 The lessee is not released from his obligation to pay rent due to the fact that , for a reason relating to his person , he is unable to exercise his right of use . However , the lessor must allow to be credited against him the value of the expenses saved and of the advantages he enjoys from exploiting the use in another way . |
| BGB 593. 5 The right to demand an amendment of the lease under subsections ( 1 ) to ( 4 ) may not be waived . An agreement that one party to the lease is to enjoy special advantages or suffer special disadvantages if he exercises or fails to exercise the rights under subsections ( 1 ) to ( 4 ) is ineffective . |
