BGB 372 Money , securities and other documents as well as valuables may be deposited by the obligor for the obligee with a public authority intended for this purpose if the obligee is in default of acceptance . The same applies if the obligor cannot fulfil his obligation or cannot do so with certainty for another reason that is in the person of the obligee or as the result of uncertainty , not due to negligence , as to the identity of the obligee .
Section 702 Limitation of liability ; valuables
BGB 702. 1 The innkeeper is only liable by reason of section 701 up to an amount corresponding to one-hundred times the cost of accommodation for one day , but at least up to the amount of 600 euros and at most up to an amount of 3,500 euros ; for money , securities and valuables the amount of 800 euros takes the place of the amount of 3,500 euros .
BGB 702. 3 The innkeeper is obliged to accept money , securities , valuables and other valuable items for safekeeping unless they are excessively valuable or sizeable in view of the size or status of the inn or if they are hazardous . He may demand that they be delivered in a closed or sealed container .
