| BGB 906. 1 The owner of a plot of land may not prohibit the introduction of gases , steam , smells , smoke , soot , warmth , noise , vibrations and similar influences emanating from another plot of land to the extent that the influence does not interfere with the use of his plot of land , or interferes with it only to an insignificant extent . An insignificant interference is normally present if the limits or targets laid down in statutes or by statutory orders are not exceeded by the influences established and assessed under these provisions . The same applies to values in general administrative provisions that have been issued under section 48 of the Federal Environmental Impact Protection Act [ Bundes-Immissionsschutzgesetz ] and represent the state of the art . |
| GG 12a. 2 Any person who , on grounds of conscience , refuses to render military service involving the use of arms may be required to perform alternative service . The duration of alternative service shall not exceed that of military service . Details shall be regulated by a law , which shall not interfere with the freedom to make a decision in accordance with the dictates of conscience , and which shall also provide for the possibility of alternative service not connected with units of the Armed Forces or of the Federal Border Police . |
| GG 87b. 1 The Federal Defence Administration shall be conducted as a federal administrative authority with its own administrative substructure . It shall have jurisdiction for personnel matters and direct responsibility for satisfaction of the procurement needs of the Armed Forces . Responsibilities connected with pensions for injured persons or with construction work may be assigned to the Federal Defence Administration only by a federal law requiring the consent of the Bundesrat . Such consent shall also be required for any laws to the extent that they empower the Federal Defence Administration to interfere with rights of third parties ; this requirement , however , shall not apply in the case of laws regarding personnel matters . |
