| BGB 151 A contract comes into existence through the acceptance of the offer without the offeror needing to be notified of acceptance , if such a declaration is not to be expected according to customary practice , or if the offeror has waived it . | BGB 434. 1 The thing is free from material defects if , upon the passing of the risk , the thing has the agreed quality .
