| BGB 481. 1 Time-share agreements are contracts by which an entrepreneur procures or promises to procure for a consumer the right , in return for the payment of a total price , to use a building for a period of the year that is specified or to be specified , for recreation or residential purposes , for the duration of at least three years . The right may be a real right or another right and may also in particular , without limitation , be granted through membership of an association or a share in a company or partnership . |
| BGB 565. 1 If under the lease agreement the lessee is to sublet the leased residential space to a third party on a commercial basis for residential purposes , then upon termination of the lease the lessor takes over the rights and duties under the lease agreement between the lessee and the third party . If the lessor enters into a new lease agreement for subletting on a commercial basis , then the lessee , in place of the previous party to the contract , takes over the rights and duties under the lease agreement with the third party . |
| BGB 593a If , on the transfer of a business by way of a lifetime transfer of property , a plot of land leased for the business that serves agricultural purposes is included , then the transferee succeeds to the usufructuary lease in place of the lessee . The usufructuary lessor must , however , be promptly notified of the transfer of business . If proper management of the leased property by the transferee is not guaranteed , then the usufructuary lessor is entitled to terminate the lease for cause with the statutory notice period . |
