BGB 959 A movable thing becomes ownerless if the owner , in the intention of waiving ownership , gives up the possession of the thing .
BGB 1137. 2 If the owner is not the personal debtor , he does not lose a defence by the latter waiving it .
BGB 1171. 1 The right of the unknown creditor may also be excluded by way of a public notice procedure if the owner is entitled to satisfy the creditor or to give notice of termination , and deposits the amount of the claim for the creditor , at the same time waiving the right of withdrawal . The deposit of interest is required only if the rate of interest is registered in the Land Register ; interest for a period earlier than the fourth calendar year prior to the exclusory order coming into legal effect is not required to be deposited .
