| BGB 161. 1 If a person has disposed of a thing , and the disposition is subject to a condition precedent , any further disposition which he makes as regards the thing in the period of suspense is ineffective on the satisfaction of the condition to the extent that it would defeat or adversely affect the effect subject to the condition . Such a disposition is equivalent to a disposition which is effected during the period of suspense by execution or attachment or by the administrator in insolvency proceedings . |
| BGB 492a. 1 If a fixed interest rate is agreed in the loan contract , and if the fixing of interest ends prior to the time determined for repayment , the lender shall inform the borrower at the latest three months prior to the end of the fixing of interest whether he is willing to reach a new agreement as regards interest . If the lender declares his willingness thereto , notification must contain the interest rate offered by the lender at the time of notification . |

| BGB 2356. 2 For proof that the testator at the time of his death was living in the matrimonial property regime of community of accrued gains , and in respect of the other information required under sections 2354 and 2355 , the applicant must declare in lieu of an oath before a court or notary that he is not aware of anything that negatives his statements . The probate court may dispense with the declaration if it regards it as unnecessary . |
