| BGB 868 If a person possesses a thing as a usufructuary , a pledgee , a usufructuary lessee , a lessee , a depositary or in a similar relationship by virtue of which he is , in relation to another , entitled to possession or obliged to have possession for a period of time , the other person shall also be a possessor ( indirect possession ) . |
| BGB 1205. 2 The delivery of possession of a thing in the indirect possession of the owner may be replaced by the owner transferring indirect possession to the pledgee and notifying the possessor of the pledging . |
| BGB 1208 If the thing is encumbered with the right of a third party , then the pledge takes priority over the right , unless the pledgee , at the time of acquisition of the pledge , is not in good faith in relation to the right . The provisions of section 932 ( 1 ) sentence 2 , section 935 and of section 936 ( 3 ) apply with the necessary modifications . |
