BGB 88 When the foundation ceases to exist , the property devolves on the persons specified in the constitution . If no persons entitled are specified , the property devolves on the treasury of the Land in which the foundation had its seat , or on another person entitled to receive under the law of this Land . The provisions of sections 46 to 53 apply with the necessary modifications .
BGB 249. 1 A person who is liable in damages must restore the position that would exist if the circumstance obliging him to pay damages had not occurred .
BGB 307. 2 An unreasonable disadvantage is , in case of doubt , to be assumed to exist if a provision is not compatible with essential principles of the statutory provision from which it deviates , or limits essential rights or duties inherent in the nature of the contract to such an extent that attainment of the purpose of the contract is jeopardised .
