The provision of section 278 applies with the necessary modifications .
BGB 273. 3 The obligee may avert the exercise of the right of retention by providing security . The providing of security by guarantors is excluded .
BGB 839. 3 Liability for damage does not arise if the injured person has intentionally or negligently failed to avert the damage by having recourse to appeal .
