=S=> BGB 1168. 1 If the creditor waives the mortgage , the owner shall acquire it .
=S=> BGB 1168. 2 The waiver must be declared to the Land Registry or to the owner and it must be registered in the Land Register . The provisions of section 875 ( 2 ) and sections 876 and 878 apply with the necessary modifications .
=S=> BGB 1168. 3 If the creditor waives the mortgage with regard to part of the claim , the owner has the rights set out in section 1145.
