BGB 2354. 1 Wer die Erteilung des Erbscheins als gesetzlicher Erbe beantragt , hat anzugeben : 1. die Zeit des Todes des Erblassers , 2. das Verhältnis , auf dem sein Erbrecht beruht , 3. ob und welche Personen vorhanden sind oder vorhanden waren , durch die er von der Erbfolge ausgeschlossen oder sein Erbteil gemindert werden würde , 4. ob und welche Verfügungen des Erblassers von Todes wegen vorhanden sind , 5. ob ein Rechtsstreit über sein Erbrecht anhängig ist .
