Er kann die Herausgabe der noch vorhandenen Nachlassgegenstände durch Zahlung des Wertes abwenden . Die rechtskräftige Verurteilung des Erben zur Befriedigung eines ausgeschlossenen Gläubigers wirkt einem anderen Gläubiger gegenüber wie die Befriedigung .
