EnglischBGB 1965. 2 A right of succession is not taken into account if it is proved to the probate court within three months after the expiry of the notification period that the right of succession exists or that it has been asserted against the treasury in a legal action . If there has been no public invitation , the three-month period begins when the judicial invitation to prove the right of succession or the filing of the claim is made .
BGB 1965. 2 Ein Erbrecht bleibt unberücksichtigt , wenn nicht dem Nachlassgericht binnen drei Monaten nach dem Ablauf der Anmeldungsfrist nachgewiesen wird , dass das Erbrecht besteht oder dass es gegen den Fiskus im Wege der Klage geltend gemacht ist . Ist eine öffentliche Aufforderung nicht ergangen , so beginnt die dreimonatige Frist mit der gerichtlichen Aufforderung , das Erbrecht oder die Erhebung der Klage nachzuweisen .
