BGB 1897. 5 If the person of full age suggests no-one who may be appointed custodian , then when the custodian is selected , account must be taken of the family and other personal ties of the person of full age , in particular the ties to parents , to children , to the spouse and to the civil partner , and of the danger of conflicts of interest .

BGB 1897. 5 Schlägt der Volljährige niemanden vor , der zum Betreuer bestellt werden kann , so ist bei der Auswahl des Betreuers auf die verwandtschaftlichen und sonstigen persönlichen Bindungen des Volljährigen , insbesondere auf die Bindungen zu Eltern , zu Kindern , zum Ehegatten und zum Lebenspartner , sowie auf die Gefahr von Interessenkonflikten Rücksicht zu nehmen .
