BGB 1786. 1 The assumption of the guardianship may be refused by the following : a parent who principally cares for two or more children who are not yet of school age or credibly establishes that the care for the family for which he is responsible permanently makes the exercise of the office particularly difficult , a person who has reached the age of sixty , a person who has the care for the person or the property of more than three minor children , a person who as the result of illness or of infirmity is prevented from conducting the guardianship properly , a person who , because of the distance of his residence from the seat of the family court , cannot conduct the guardianship without particular inconvenience ,

BGB 1786. 1 Die Übernahme der Vormundschaft kann ablehnen : 1. ein Elternteil , welcher zwei oder mehr noch nicht schulpflichtige Kinder überwiegend betreut oder glaubhaft macht , dass die ihm obliegende Fürsorge für die Familie die Ausübung des Amts dauernd besonders erschwert , 2. wer das 60. Lebensjahr vollendet hat , 3. wem die Sorge für die Person oder das Vermögen von mehr als drei minderjährigen Kindern zusteht , 4. wer durch Krankheit oder durch Gebrechen verhindert ist , die Vormundschaft ordnungsmäßig zu führen , 5. wer wegen Entfernung seines Wohnsitzes von dem Sitz des Familiengerichts die Vormundschaft nicht ohne besondere Belästigung führen kann , 6. ( weggefallen ) 7. wer mit einem anderen zur gemeinschaftlichen Führung der Vormundschaft bestellt werden soll , 8. wer mehr als eine Vormundschaft , Betreuung oder Pflegschaft führt ; die Vormundschaft oder Pflegschaft über mehrere Geschwister gilt nur als eine ; die Führung von zwei Gegenvormundschaften steht der Führung einer Vormundschaft gleich .
