BGB 1750. 3 Die Einwilligung kann nicht durch einen Vertreter erteilt werden . Ist der Einwilligende in der Geschäftsfähigkeit beschränkt , so bedarf seine Einwilligung nicht der Zustimmung seines gesetzlichen Vertreters . Die Vorschrift des § 1746 Abs . 1 Satz 2 , 3 bleibt unberührt .
