BGB 1673. 2 The same applies if he has limited capacity to contract . Die Personensorge für das Kind steht ihm neben dem gesetzlichen Vertreter des Kindes zu ; zur Vertretung des Kindes ist er nicht berechtigt . Bei einer Meinungsverschiedenheit geht die Meinung des minderjährigen Elternteils vor , wenn der gesetzliche Vertreter des Kindes ein Vormund oder Pfleger ist ; andernfalls gelten § 1627 Satz 2 und § 1628.
