BGB 1643. 2 Das Gleiche gilt für die Ausschlagung einer Erbschaft oder eines Vermächtnisses sowie für den Verzicht auf einen Pflichtteil . Tritt der Anfall an das Kind erst infolge der Ausschlagung eines Elternteils ein , der das Kind allein oder gemeinsam mit dem anderen Elternteil vertritt , so ist die Genehmigung nur erforderlich , wenn dieser neben dem Kind berufen war .
