BGB 1513. 1 Each spouse may , for the eventuality that on his death the continued community of property occurs , by testamentary disposition deprive a descendant entitled to a share of the share of the marital property to which that descendant is entitled after the end of the continued community of property if the spouse is entitled to deprive the descendant of his compulsory share . The provision of section 2336 ( 2 ) to ( 4 ) applies with the necessary modifications .

BGB 1513. 1 Jeder Ehegatte kann für den Fall , dass mit seinem Tod die fortgesetzte Gütergemeinschaft eintritt , einem anteilsberechtigten Abkömmling den diesem nach der Beendigung der fortgesetzten Gütergemeinschaft gebührenden Anteil an dem Gesamtgut durch letztwillige Verfügung entziehen , wenn er berechtigt ist , dem Abkömmling den Pflichtteil zu entziehen . Die Vorschrift des § 2336 Abs . 2 und 3 findet entsprechende Anwendung .
