BGB 1501. 2 Der überlebende Ehegatte kann mit den übrigen anteilsberechtigten Abkömmlingen schon vor der Aufhebung der fortgesetzten Gütergemeinschaft eine abweichende Vereinbarung treffen . Die Vereinbarung bedarf der notariellen Beurkundung ; sie ist auch denjenigen Abkömmlingen gegenüber wirksam , welche erst später in die fortgesetzte Gütergemeinschaft eintreten .
