Der Verzicht erfolgt durch Erklärung gegenüber dem für den Nachlass des verstorbenen Ehegatten zuständigen Gericht ; die Erklärung ist in öffentlich beglaubigter Form abzugeben . Das Nachlassgericht soll die Erklärung dem überlebenden Ehegatten und den übrigen anteilsberechtigten Abkömmlingen mitteilen .
