Steht der überlebende Ehegatte unter elterlicher Sorge oder unter Vormundschaft , so ist zur Ablehnung die Genehmigung des Familiengerichts erforderlich . Bei einer Ablehnung durch den Betreuer des überlebenden Ehegatten ist die Genehmigung des Betreuungsgerichts erforderlich .
