BGB 1483. 1 The spouses may agree by marriage contract that the community of property , after the death of a spouse , is continued between the surviving spouse and the descendants of the spouses . BGB 1483. 1 Die Ehegatten können durch Ehevertrag vereinbaren , dass die Gütergemeinschaft nach dem Tod eines Ehegatten zwischen dem überlebenden Ehegatten und den gemeinschaftlichen Abkömmlingen fortgesetzt wird . Treffen die Ehegatten eine solche Vereinbarung , so wird die Gütergemeinschaft mit den gemeinschaftlichen Abkömmlingen fortgesetzt , die bei gesetzlicher Erbfolge als Erben berufen sind . Der Anteil des verstorbenen Ehegatten am Gesamtgut gehört nicht zum Nachlass ; im Übrigen wird der Ehegatte nach den allgemeinen Vorschriften beerbt .
