BGB 1478. 1 Ist die Ehe geschieden , bevor die Auseinandersetzung beendet ist , so ist auf Verlangen eines Ehegatten jedem von ihnen der Wert dessen zurückzuerstatten , was er in die Gütergemeinschaft eingebracht hat ; reicht hierzu der Wert des Gesamtguts nicht aus , so ist der Fehlbetrag von den Ehegatten nach dem Verhältnis des Wertes des von ihnen Eingebrachten zu tragen .
