BGB 1425. 1 Der Ehegatte , der das Gesamtgut verwaltet , kann nur mit Einwilligung des anderen Ehegatten Gegenstände aus dem Gesamtgut verschenken ; hat er ohne Zustimmung des anderen Ehegatten versprochen , Gegenstände aus dem Gesamtgut zu verschenken , so kann er dieses Versprechen nur erfüllen , wenn der andere Ehegatte einwilligt . Das Gleiche gilt von einem Schenkungsversprechen , das sich nicht auf das Gesamtgut bezieht .
