EnglischBGB 1238. 2 If the sale is effected without this provision , the sale price is to be seen as received by the pledgee ; the rights of the pledgee against the buyer are unaffected . If the immediate payment of the sale price is not made , the same applies , unless the reservation of the forfeiture of rights is invoked before the end of the auction .
BGB 1238. 2 Erfolgt der Verkauf ohne diese Bestimmung , so ist der Kaufpreis als von dem Pfandgläubiger empfangen anzusehen ; die Rechte des Pfandgläubigers gegen den Ersteher bleiben unberührt . Unterbleibt die sofortige Entrichtung des Kaufpreises , so gilt das Gleiche , wenn nicht vor dem Schluss des Versteigerungstermins von dem Vorbehalt der Rechtsverwirkung Gebrauch gemacht wird .
