BGB 1179a. 4 If the priority of a mortgage is reduced , subsections ( 1 ) to ( 3 ) apply with the necessary modifications to the deletion of the mortgage that is prior or equal in rank to it as a result of the change of priority , provided that the time of the registration of the change of priority takes the place of the time of registration of the right with lower priority .

BGB 1179a. 4 Tritt eine Hypothek im Range zurück , so sind auf die Löschung der ihr infolge der Rangänderung vorgehenden oder gleichstehenden Hypothek die Absätze 1 bis 3 mit der Maßgabe entsprechend anzuwenden , dass an die Stelle des Zeitpunkts der Eintragung des zurückgetretenen Rechts der Zeitpunkt der Eintragung der Rangänderung tritt .
