BGB 1028. 1 Ist auf dem belasteten Grundstück eine Anlage , durch welche die Grunddienstbarkeit beeinträchtigt wird , errichtet worden , so unterliegt der Anspruch des Berechtigten auf Beseitigung der Beeinträchtigung der Verjährung , auch wenn die Dienstbarkeit im Grundbuch eingetragen ist . Mit der Verjährung des Anspruchs erlischt die Dienstbarkeit , soweit der Bestand der Anlage mit ihr in Widerspruch steht .
