BGB 851 If the person liable to pay damages for the deprivation of a person or for damage to a movable thing pays compensation to the person in whose possession the thing was at the time when the deprivation or damage occurred , then by this payment of compensation he is released , even if a third party was the owner of the thing or had another right in the thing , unless he knows of the right of the third party or his lack of knowledge results from gross negligence .
