EnglischBGB 706. 2 If fungible or consumable things are to be contributed , then in case of doubt it is to be assumed that they are to be the joint property of the partners . The same applies to non-fungible and non-consumable things if they are to be contributed according to an appraisal that is not merely intended for the profit distribution .
BGB 706. 2 Sind vertretbare oder verbrauchbare Sachen beizutragen , so ist im Zweifel anzunehmen , dass sie gemeinschaftliches Eigentum der Gesellschafter werden sollen . Das Gleiche gilt von nicht vertretbaren und nicht verbrauchbaren Sachen , wenn sie nach einer Schätzung beizutragen sind , die nicht bloß für die Gewinnverteilung bestimmt ist .
