BGB 567a If , prior to transferring the use of the leased residential space to the lessee , the lessor disposes of the residential space to a third party or encumbers it with a right by the exercise of which the lessee is deprived of or restricted in the use of it in conformity with the contract , then the same applies as in the cases of sections 566 ( 1 ) and 567 if the acquirer has agreed with the lessor to take over the performance of the duties arising from the lease agreement .

BGB 567a Hat vor der Überlassung des vermieteten Wohnraums an den Mieter der Vermieter den Wohnraum an einen Dritten veräußert oder mit einem Recht belastet , durch dessen Ausübung der vertragsgemäße Gebrauch dem Mieter entzogen oder beschränkt wird , so gilt das Gleiche wie in den Fällen des § 566 Abs . 1 und des § 567 , wenn der Erwerber dem Vermieter gegenüber die Erfüllung der sich aus dem Mietverhältnis ergebenden Pflichten übernommen hat .
