BGB 543. 4 Sections 536b and 536d are to be applied with the necessary modifications to the right to notice of termination to which the lessee is entitled under subsection ( 2 ) no . 1. BGB 543. 4 Auf das dem Mieter nach Absatz 2 Nr . 1 zustehende Kündigungsrecht sind die §§ 536b und 536d entsprechend anzuwenden . Ist streitig , ob der Vermieter den Gebrauch der Mietsache rechtzeitig gewährt oder die Abhilfe vor Ablauf der hierzu bestimmten Frist bewirkt hat , so trifft ihn die Beweislast .
