BGB 356. 1 The right of revocation under section 355 may , to the extent expressly permissible by statute , where the contract is entered into on the basis of a sales prospectus , be replaced in the contract by an unlimited right of return . BGB 356. 1 Das Widerrufsrecht nach § 355 kann , soweit dies ausdrücklich durch Gesetz zugelassen ist , beim Vertragsschluss auf Grund eines Verkaufsprospekts im Vertrag durch ein uneingeschränktes Rückgaberecht ersetzt werden . Voraussetzung ist , dass 1. im Verkaufsprospekt eine den Anforderungen des § 360 Abs . 2 entsprechende Belehrung über das Rückgaberecht enthalten ist und 2. der Verbraucher den Verkaufsprospekt in Abwesenheit des Unternehmers eingehend zur Kenntnis nehmen konnte .
