BGB 312. 3 The right of revocation or right of return , notwithstanding other provisions , does not exist in the case of insurance contracts or if in the case of subsection ( 1 ) no . 1 , the oral negotiations on the basis of which the contract was entered into were conducted in response to a previous order placed by the consumer , or the performance is immediately rendered and paid for at the conclusion of the negotiations and remuneration does not exceed forty euros , or the declaration of intention of the consumer has been recorded by a notary .

BGB 312. 3 Das Widerrufs - oder Rückgaberecht besteht unbeschadet anderer Vorschriften nicht bei Versicherungsverträgen oder wenn 1. im Falle von Absatz 1 Nr . 1 die mündlichen Verhandlungen , auf denen der Abschluss des Vertrags beruht , auf vorhergehende Bestellung des Verbrauchers geführt worden sind oder 2. die Leistung bei Abschluss der Verhandlungen sofort erbracht und bezahlt wird und das Entgelt 40 Euro nicht übersteigt oder 3. die Willenserklärung des Verbrauchers von einem Notar beurkundet worden ist .
