BGB 216. 2 If a right has been procured for the purpose of securing a claim , the retransfer of the right may not be demanded on the basis of the limitation of the claim . BGB 216. 2 Ist zur Sicherung eines Anspruchs ein Recht verschafft worden , so kann die Rückübertragung nicht auf Grund der Verjährung des Anspruchs gefordert werden . Ist das Eigentum vorbehalten , so kann der Rücktritt vom Vertrag auch erfolgen , wenn der gesicherte Anspruch verjährt ist .
